Terms of Service

These terms are the agreement between your business and Sitegride. They cover what we provide, what we ask of you, and what each of us is responsible for when something goes wrong.

The agreement

By opening an account, or by using Sitegride, you accept these terms on behalf of your business. If you are agreeing for a company, you confirm you are entitled to bind it. In these terms, "we" and "us" mean Sitegride; "you" means the business holding the account, and everyone you give access to.

If you do not accept these terms, do not use the service.

What Sitegride is

Sitegride is software for recording and reporting on construction sites and the money that moves through them: sites, unit sales and rentals, procurement, labour, sub-contractors, money flow and reports, in English and Gujarati.

It is a record-keeping tool. It is not accounting, tax, legal or financial advice, and it is not a substitute for your accountant or your auditor. Figures it computes are computed from what your team enters, so their accuracy follows from the entries.

Accounts, staff and access

  • You are responsible for who you give access to and what role you give them, and for everything they do with that access.
  • Keep credentials to yourself. Tell us promptly at the support address if you think an account has been reached by someone who should not have it.
  • The information you give us when opening an account must be accurate, and kept up to date.
  • You must be at least eighteen and able to enter a contract.

Your data

What your team enters stays yours. We claim no ownership of it. We process it to provide the service, and for nothing else. We do not sell it, and we do not use it to train anything.

You can export your records at any time while the account is open. Our handling of personal information is set out in the Privacy Policy, which forms part of these terms.

Acceptable use

Do not use Sitegride to:

  • Break the law, or help anyone else break it.
  • Store or send anything you have no right to, or anything unlawful.
  • Reach parts of the service, or another account, that you have not been given access to.
  • Probe, scrape, overload or interfere with the service, or work around any limit or security measure in it.
  • Copy, resell or rent the service, or offer it to a third party as your own.

Plans, payment and taxes

  • Plans are priced per business rather than per entry, and the current prices are the ones shown on the pricing page.
  • Fees are payable in advance for the term of the plan and are stated exclusive of taxes; applicable taxes are added.
  • We may change prices. Existing customers get at least thirty days notice before a change applies to them, and it will not apply within a term already paid for.
  • Fees already paid are not refundable except where the law requires it, or where we have said otherwise in writing.

Trials and pilots

Where we offer a free trial or a pilot, it runs for the period we state and can be ended by either of us at any time. A trial is provided as it is, with no commitment to availability, and anything we agree specifically for a pilot takes precedence over this section.

Availability and support

We work to keep the service available, and we take backups. We do not promise uninterrupted service: maintenance happens, and so do failures at providers we depend on. Where we can plan an interruption we will give notice.

Support is by email at support@sitegride.com, in English or Gujarati. We aim to answer within one working day.

Third-party services

The service depends on suppliers such as hosting, database and map providers, and may link to sites we do not run. We are not responsible for those third parties or for what is on their sites, and your use of them is governed by their own terms.

Our intellectual property

The software, the name, the mark and the design are ours and remain ours. You get a non-exclusive, non-transferable right to use the service for your own business, for as long as your account is in good standing. Nothing here transfers ownership to you, and you may not copy, decompile or create derivative works from the software.

Disclaimers

The service is provided as it is and as available. To the extent the law allows, we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be error-free, or that the figures it reports will meet a legal or accounting standard, because those figures come from your entries.

Limitation of liability

To the extent the law allows, neither of us is liable to the other for indirect or consequential loss, or for lost profits, lost business, lost goodwill or lost or corrupted data arising from the use of the service.

Our total liability arising out of or in connection with these terms is limited to the fees you paid us in the twelve months before the event giving rise to the claim.

Nothing in these terms excludes liability that cannot lawfully be excluded, including for fraud or for death or personal injury caused by negligence.

Suspension and termination

  • You may close your account at any time. Export your records first: after closure we keep them only briefly so the account can be restored, and then delete them.
  • We may suspend or close an account that breaches these terms, that is used unlawfully, or that has fees outstanding after we have asked for them. Where the circumstances allow it, we will warn you first and give you a chance to put it right.
  • The sections on your data, our intellectual property, disclaimers, liability and governing law survive the end of this agreement.

Changes to the service and to these terms

We improve the service continually, and parts of it will change. We will not remove a material feature you rely on without notice. When we change these terms we will update the date at the top, and for a material change we will tell you at least thirty days in advance. Continuing to use the service after a change takes effect means you accept it. The current version always lives at https://sitegride.com/en/terms.

Governing law

These terms are governed by the laws of India. The courts at Ahmedabad, Gujarat have exclusive jurisdiction, and both of us submit to it. Before starting proceedings, each of us agrees to raise the matter in writing and give the other thirty days to resolve it.
